This term in the real estate market represents an unconditional consent for registration in the land registry, i.e., a statement from the previous owner of the property (seller, donor&#8230;) allowing the registration to another person, without their further consent and presence.\n<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.heroldo.com\/wp-content\/uploads\/2023\/01\/home-g72fe8ed94_1920.jpg\"\/><\/p>\n<p>\n\u201c<strong><em>Clausula intabulandi\u201d<\/em><\/strong> can be an integral part of the Contract where, by signing and notarizing it with a public notary, the new owner of the property is granted the right to be registered as the owner, i.e., to have ownership rights recorded in the land registry.\n<\/p>\n<p>\nConsent for the registration of the new owner in the land registry can also be given subsequently, through a separate document. The subsequent consent of the previous owner of the property, i.e., <strong><em>\u201cclausula intabulandi\u201d<\/em><\/strong> is given in the form of a separate statement, most often in cases of purchasing real estate through a housing loan, where it is awaited for the loan money to be credited to the seller&#8217;s account.\n<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.heroldo.com\/wp-content\/uploads\/2023\/01\/real-estate-ga9d7d4bee_1920.jpg\"\/><\/p>\n<p>\nWhen <em>\u201c<\/em><strong><em>clausula intabulandi<\/em><\/strong><strong><em>\u201d<\/em><\/strong> is given through a separate statement, the new owner of the apartment will initially receive a rejection decision from the land registry after notarizing the Contract with a public notary, and this should not worry the new owners, as they will be registered in the land registry with ownership rights to the respective property after notarizing the Statement with a public notary.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Whether you are buying real estate or receiving it as a gift, exchanging it, or undertaking other actions, it is inevitable that you will encounter the Latin term \u201cCLAUSULA INTABULANDI\u201d which is used today not only by lawyers but also by the general public.
