Legalization of properties – all necessary documentation

Illegal properties cannot be found in the real estate market – without usage and construction permits. Compared to the previous decade, the legalization process has been significantly eased, and the costs are also considerably lower.

While we await the decision on the new legalization process, which has been announced for the fall of this year, let us familiarize ourselves with the necessary documentation for the legalization of properties.

The request for legalization includes:

The cover page (as prescribed by the Ministry of Construction, Transport and Infrastructure),

a record of the actual state of the property in question,

a statement from the responsible designer/responsible contractor,

a statement from the owner of the illegally constructed property accepting any potential risk of using the property, given the minimal technical documentation required for legalization,

Technical documentation:

a certificate of registration of the company preparing the documentation,

a decision on responsible designers,

licenses of responsible designers,

a report on the degree of completion of the property,

a technical report on the architecture of the property,

a description of the condition of the property’s structure,

a description of the condition of plumbing, sewage, electrical installations, and heating installations,

graphic documentation (drawings) showing and calculating all surfaces of the property (NET and GROSS)

Elaborate of geodetic works:

a copy of the site plan, with the height of the property marked (if the property is registered in the Cadastre),

gelaborate of geodetic works (if the property is not registered in the Cadastre)

geodetic elaboration of special parts of the property (in case the property has more than one apartment or a garage within the property),

In case you do not possess the project and other necessary documentation, you will need an architect to outline all the properties and a surveyor in case of extensions to the properties on the site. After the house is 100% completed, the commission will go to the site to inspect the properties and write a report based on which a usage permit is issued.

The fees for legalization are fixed and determined by the competent authorities of local self-governments. Their amounts depend on the square footage and purpose of the illegal properties.
